1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Ennube.ai website and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.
If you are using our Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.
2. Description of Services
Ennube.ai provides AI agents designed to automate repetitive tasks, analyze customer data, and enhance CRM workflows. Our Services include access to our website, API, and related tools.
3. Account Registration and Security
To access certain features of our Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscription and Payments
Some of our Services require payment. If you subscribe to a paid plan, you agree to pay the fees according to the pricing and terms presented to you at the time of purchase.
Unless otherwise stated, subscriptions will automatically renew for additional periods equal to the expiring subscription term. You may cancel auto-renewal at any time through your account settings.
5. User Content and License
Our Services may allow you to upload, submit, store, send, or receive content ("User Content"). You retain ownership of any intellectual property rights that you hold in that User Content.
By uploading User Content, you grant Ennube.ai a worldwide, royalty-free license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such User Content for the limited purpose of providing the Services.
6. Acceptable Use
You agree not to misuse our Services. For example, you must not:
- Use the Services for any illegal purpose or in violation of any laws
- Violate or infringe other people's intellectual property, privacy, or other rights
- Engage in any activity that interferes with or disrupts the Services
- Attempt to bypass or break any security mechanism on the Services
- Post or transmit any content that is fraudulent, false, misleading, deceptive, or invasive of another's privacy
7. Intellectual Property Rights
The Services and their original content, features, and functionality are owned by Ennube Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
8. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
IN NO EVENT SHALL ENNUBE INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through our Services or by other means.
Your continued use of the Services after such notice constitutes your acceptance of the modified Terms.
